SMS Message Service Conditions
In compliance with the provisions of Law 34/2002, dated July 11 on IS Services and E-Commerce and other applicable regulations, you are duly informed by La Manga Club S.L. as follows:
GENERAL CONDITIONS OF THE LA MANGA CLUB SMS MESSAGING SERVICE
These conditions govern the provision of a subscription service providing clients with informative and promotional information about products and services provided by La Manga Club S.L. via SMS (text messages) via the mobile telephone network. Subscription to the SMS message service implies full and unreserved acceptance of these conditions:
PURPOSE
La Manga Club S.L. is interested in keeping you informed about services and activities you can enjoy during your stay at La Manga Club Resort. La Manga Club SL offers an SMS message service which entails sending SMS (text) messages regarding the company’s products and services, as well as special offers and discounts, to CLIENTS. Subscription to the service by the CLIENT presupposes abidance by these Conditions from the time of subscribing. .
The information you will receive through this subscription are the same services and products as can be found on this website belonging to LA MANGA CLUB, although the company reserves the right modify prices as well as products and services offered during the term of this contract.
OWNERSHIP OF THE SERVICE
The messaging service provider is La Manga Club S.L. of the following address: La Manga Club, 30389 Cartagena, Murcia, Spain and registered in the Mercantile Registry of Murcia, Volume 446, section 3, Company Book folio 190, page 7765, entry 1, with CIF number: B-30630511, hereinafter, LA MANGA CLUB.
SUBSCRIPTION TO THE SERVICE
CLIENTS interested in subscribing to the messaging service and receiving messages must send a send an SMS (text message) from the mobile phone upon which they wish to receive messages with the text ALTALaMangaClub to +34 661 445 098 if they wish to receive messages in Spanish or an SMS (text message) with the text OFFERSLaMangaClub to +34 661 445 098 if they prefer to receive messages in English.
The cost of sending the SMS (text message) to subscribe to the service will depend on the rates charged by the client’s mobile phone service provider, with no additional charge on the part of La Manga Club S.L.
DURATION AND RENEWAL
The message subscription service will be for a duration of 5 days from the time of subscription to the service by the CLIENT.
After 5 days has lapsed, the client will automatically be unsubscribed from the service.
Should the CLIENT wish to continue subscribing, they should send another SMS (text message) from the mobile phone upon which they wish to receive messages with the text ALTALaMangaClub to +34 661 445 098 if they wish to receive messages in Spanish or an SMS (text message) with the text OFFERSLaMangaClub to +34 661 445 098 if they prefer to receive messages in English, in order to resubscribe.
COST: The reception of SMS messages is free and there is no cost to the CLIENT. The messages will be received on the mobile telephone number from which the customer has subscribed to the service.
UNSUBSCRIBING
Subscription to the SMS messaging service will automatically cease 5 days after subscription.

INTELLECTUAL PROPERTY RIGHTS
All content included on the LA MANGA CLUB SMS messaging service is subject to the intellectual property rights of La Manga Club and / or third party content providers. Access to such content by the CLIENT in no way implies any waiver, transfer or sale of all or part of such rights, or nor does it confer any right of commercial exploitation, reproduction, distribution or public communication of the contents other than those expressly set forth in these conditions, without express prior authorization specifically granted for that purpose by La Manga Club.
It is strictly forbidden to modify, transmit, distribute, reuse, repost, or use all or part of the contents of the page for public or commercial purposes without the authorisation of La Manga Club S.L.
Violation of any of these rights may constitute a violation of the provisions of Legislative Decree of Intellectual Property Law 1 / 1996.
USE OF INFORMATION RECEIVED
Information is provided for the exclusive use of the CLIENT, who may not, under any circumstances unless authorized in writing by LA MANGA CLUB:
Pass on, transfer, assign, sublease, sublicense, sell or make any other use of the SMS message, either for free or for a fee.
Alter, transform or otherwise modify all or part of the received message.
The CLIENT shall not use SMS messages received for purposes or intents that are illegal, prohibited in these Conditions or are prejudicial to the rights and interests of others and of LA MANGA CLUB. In such cases, LA MANGA CLUB may suspend the service, and claim damages from the CLIENT.
The CLIENT may not manipulate or use the SMS messages received to trade with them, or to create publications and / or public access services of any kind, and especially those that are comparable to or interfere with publications and / or services that LA MANGA CLUB offers or may offer. The incorporation of content included in LA MANGA CLUB’S products and services in websites accessible by third parties and public databases, regardless of the media used and whether free or paid, is strictly prohibited.
Access to the SERVICE by the CLIENT may be cancelled if LA MANGA CLUB detects patterns of use contrary to the provisions of these Conditions and especially fraudulent document capture and reuse of information for commercial purposes.
The presentation of products and/or services in the SMS message service does not, in itself, constitute an offer to sell the same from a contractual point of view, but is merely a showcase of the products offered by La Manga Club S.L. which are subject to their own conditions of use.
LIABILITY
The CLIENT agrees that the information provided in the SMS messages may not include all the conditions of the service or product offered.
The CLIENT may not impose liability for damages arising from errors and / or incorrect or inaccurate information provided by La Manga Club S.L. although the company shall always endeavour to ensure that the information provided is accurate and reliable.
La Manga Club S.L. shall not be liable for any damage or loss resulting from negligence, delay or error in the SMS messages received.
Furthermore, La Manga Club S.L. shall not be liable for any loss or damage that may result from incorrect functioning of the SMS subscription service resulting from external technical equipment, including any hardware required to run the service and expressly renounces any liability in the event of telephone data network malfunction.
LA MANGA CLUB S.L. reserves the right to suspend part or all of the service without prior notice for technical purposes or due to faults.
JURISDICTION AND SUBMISSION
These conditions are governed by Spanish law. The parties agree of their own will to submit to the jurisdiction of the courts of the city of Cartagena for the resolution of any conflict and expressly renounce any other jurisdiction that may apply.
